Welcome to Welcome English. These are the legal terms governing your use of our website, courses (Live Class, Self-Paced), and auxiliary services.

1. Introduction and Acceptance

Welcome English is a Limited Liability Company (LLC) formed and operating under the laws of the United States. By accessing our website, registering an account, or purchasing a course, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use, along with our Privacy Policy and Payment Policy.

2. Service Definitions

We provide specialized English training programs for the Hospitality industry (Restaurants & Hotels), including but not limited to:

• Live Class: Online or in-person classes featuring real-time interaction with an Instructor.
• Self-Paced: Pre-recorded video courses and materials, allowing students to learn at their own pace.
• Addons: Auxiliary services, tutoring sessions, or extended learning materials.

3. Account and Security

• Identity Accuracy: You agree to provide accurate, current, and complete information (Full Name, Email, Phone Number) that matches your legal identification documents.
• Single User License: Each account is granted a Single User License.
• Account Sharing Prohibited: Account sharing is strictly prohibited. Our system utilizes security mechanisms to detect irregular login patterns. We reserve the right to permanently terminate any account found in violation of this policy without refund.

4. Course Regulations

4.1. For Live Classes (Instructor-Led)

• Punctuality: Students are expected to join the class on time. The Instructor reserves the right to deny entry to any student arriving more than 15 minutes late to ensure the quality of instruction.
• Cancellation/Rescheduling: All cancellation or rescheduling requests must follow the procedures outlined in Section 6.
• Recording Policy: To protect the privacy of Instructors and other students, you are strictly prohibited from recording audio or video of the sessions. Welcome English reserves the right to record sessions for Quality Assurance (QA) purposes (with prior notice).

4.2. For Self-Paced Courses (Digital Products)

• Lifetime Access: Purchasing a Self-Paced course grants you "Lifetime Access".
  • Legal Disclaimer: "Lifetime" is defined as the lifetime of the product or as long as Welcome English continues to offer the service. In the event we discontinue the service, you will be notified 30 days in advance.
• No Refunds: Due to the nature of digital goods which can be instantly consumed/copied, Self-Paced courses are Non-Refundable once the course has been activated or the first lesson has been accessed.

5. Code of Conduct (Instructor & Student Rights)

• Zero Tolerance Policy: We foster a safe, inclusive, and respectful educational environment. We strictly prohibit harassment, bullying, hate speech, or discrimination of any kind based on race, color, ethnicity, national origin, citizenship status, religion, age, sex, sexual orientation, gender identity or expression, marital status, disability, or any other characteristic protected by applicable law.
• Prohibited Behaviors: Students must not use vulgar, obscene, or abusive language. Any behavior deemed by the Instructor or Welcome English to be threatening, offensive, or disruptive to the learning experience of others is grounds for immediate removal.
• Instructor Rights: Instructors have the full authority to request Welcome English to suspend or permanently terminate the account of any student who violates this Code of Conduct, without eligibility for a refund.

6. Cancellation and Rescheduling Policy (Live Class)

• Notification: Students must notify us of an absence at least 24 hours prior to the scheduled class time via official support channels.
• Consequences:
  • Notice > 24 hours: The class credit is retained or rescheduled (subject to current policy).
  • Notice < 24 hours or No-show: The session is considered completed and deducted from the total course credits.
• Provider Cancellation: If Welcome English cancels a class due to technical issues or instructor illness, students will be offered a make-up class or a refund of that specific session's credit.

7. Intellectual Property (IP) Rights

• Ownership: All curriculum, slide decks, videos, logos, and Welcome English trademarks are the exclusive intellectual property of the Company.
• Limited License: You are granted a Limited License for personal, non-commercial learning purposes only. You may not copy, distribute, resell, or share materials on public platforms (e.g., Google Drive, Facebook Groups, YouTube) in any form.
• Violation Consequences: Any IP infringement will result in immediate account termination, liability for damages, and prosecution under applicable laws (including Vietnam Intellectual Property Law and the U.S. Digital Millennium Copyright Act - DMCA).

8. Disclaimer of Warranties

• Welcome English is committed to training quality but makes no guarantees regarding specific outcomes (e.g., promotion, salary increase, passing certification exams), as these depend on individual student effort.
• Services are provided on an "As Is" basis. We are not liable for technical interruptions caused by the user's internet connection or device.

9. Governing Law and Dispute Resolution

• Consumer Protection: These terms are governed by the laws of Vietnam regarding matters related to consumer protection within Vietnam.
• Corporate Structure: The corporate status and internal structure of Welcome English are governed by the laws of the United States.
• Dispute Resolution: Any dispute shall first be resolved through amicable negotiation. If negotiation fails, the dispute shall be submitted to the Competent Court.
